I’ve just filed a complaint with your Consumer Financial Protection Bureau, Complaint # 140506-000027, and I am hoping that you and John can also get together some time and review the situation, and help us all get to an equitable resolution.
I retired to Texas in 2001 and took out a 15 year mortgage on my little homestead. I like Texas. For some reason yet unknown, my mortgage outfit launched a foreclosure action in 2012 and attempted to sell my house on their ‘rocket docket,’ an odd thing we do here in Texas as it is usually quite expeditious. The day before the sale I chose to protect my assets through a strategic Chapter 13 Bankruptcy action, which is now almost complete. My Trustee, Deborah Langehennig, paid off the eventual Proof of Claim, including a variety of fraudulent additional charges, and the mortgage outfit has properly filed the Release of Lien here in Burnet County. Note that the mortgage is paid completely, and I now own the house three years earlier than our commitment.
I now only need to recover the escrow funds, still held and apparently lost somewhere on 1 Mortgage Way up there in New Jersey, and recover my legal expense for defense of action. I feel sure we will manage that in time, and I don’t need your assistance for those few thousand dollars.
I would like to enlist your aid in ending the particular sleazy practice of these lenders, which has become widespread here in Texas and elsewhere. All 50 State AG’s have agreed on consent judgments with Chase/JPM/BAC, and Ocwen last year and accepted large sums of money for restitution, and the companies have promised to go and sin no more. No one has reached a public agreement with PHH Mortgage as yet.
I have reported the fraudulent activity in my case to the local FBI/DOJ and preserved my standing as First Relator, and hope to eventually represent my Class. I’m organizing and planning to take a qui tam action at some point, on behalf of the United States Consumer Financial Protection Bureau. No jury has ever been empaneled to consider these matters, as they are generally resolved before these TooBigToFail companies are actually jeopardized. Our current AG also espouses the philosophy of TooBigToJail, but things change. I’d love to enlist your support to help catalyze a change.
